Idependent Character in Squad Question

Hi all,

This question came up the other day playing one of my mates. Someone he had previously played pulled this and neither of us could figure it out from the rules (not that it was a problem in the end).

The issue is this (using my models as examples). There is an IC (Lysander) in a squad (sternguard), they have taken a number of casualties already, you have a unit (demon prince) which wants to shoot at the unit then charge. All simple at the moment however... What happens if during the shooting you kill off all the squad and leave the IC? Can you still charge him now that technically he counts as a separate unit?

In my mind it wouldnt matter because you have by the virtue of shooting at the squad that he originally belonged to you have shot at him. IMO it is a very cheeky way of avoiding an IC getting charged. I must raise again that I was not the one who created this little interpretation of the rules and either way his DP was going to charge into Lysander and get a royal fist of dorning (as it happened he didnt kill all my stern anyway so it didnt matter).

So peoples, whats the rule book say about this one that we couldnt find? Exausted the Independent Character pages looking for this one.

It has nothing to do with him becoming an independent character, really. When the unit was firing at the unit he was with, he was among the models targeted by the shooting. Even if the unit gets wiped out and only the IC remains, that unit had jsut fired at the IC and his company, so the IC is a viable assault target.
