If there is a melee in the way (and you still manage LOS through it), the target will recieve a cover save. Yep, your not allowed to shoot at models in mellee, but you may shoot through a mellee, if you can see it you can shoot it, only exceptons are if the target unit is locked in combat, its out of range, out of spoting distance (for night fighting and simlar rules), times when you are not allowed to shoot at all (such as if you moved with a heavy weapon), and if you are unable to place a template/blast marker so it doesnt hit a unit in mellee. Might be some I missed but either way, shooting though a melee is no different than shooting through an enemy/ally not in melee.
