Kill team Movement

Hey all, got a question that turned up in my recent game

my opponent had 7 models left, I had 16. He moved all he could and then I fell back with one of my guys from combat, would his model be allowed to do a full move or not including charged? We could not find a rule either way and neither of us were sure, so we rolled off and decided on normal moves, etc but no charges. Was this right?

If I'm understanding you correctly, he moved first and moved all his models. Then you moved all of your models, one of which Fell Back out of combat with one of his models. Please correct me if I'm wrong about the circumstance.

In this circumstance, he would not be allowed to move, because he's already had his movement phase.

You can make a normal move when your model didn't start the phase within 1" of an enemy model.

You can make a fall back move when your model didn't get charged that phase.

So if your opponent moved all his models first but didn't lock your model in melee by charging it with another model (or by locking it physically in a space where it can't move without getting within 1" of another of his models) then you are free to fall back when it's your turn to move.

Now your opponent has used up his movement phase and you have used yours. Just because one of his models is free to move again and didn't yet move it doesn't mean he gets another go at it. His movement phase is done and it's his loss that he didn't prevent you from falling back in your movement phase. Going first is not always a good thing in Kill Team.
