It appears you are correct. He was in Legends for the duration of his availability in 9th, but was included with the 10th-Ed lineup of Space Marine datacards. Then promptly demoted again in favor of the Company Heroes unit for the Codex. Must have been a glorious three months. Custodes have: Trajan, Valerian & Aleya, Shield Captain, Blade Champion, Custodian Guard, Custodian Wardens, Vertus Praetors, Allarus Terminators, Sisters of Silence, Contemptor Dreadnought, Rhino, Land Raider. Total: 12 I'm sure some people would choose to remove the Contemptor, Rhino & Land Raider claiming that they aren't Custodes units (which isn't true, they're in the Codex) but that still leaves 9 kits, more than the Ultramarines. More importantly, most of the Custodes kits are generic units so will get more use and value compared to the Ultramarines, where every kit is something unique (apart from the Victrix Guard maybe) and mostly characters, Also, a number of the Custodes kits have multiple builds, often also allowing characters or unit variants to be built.
