As of Imperial Armour Aeronautica, it clearly shows which vehicles can and cannot be used in Warhammer 40k games.

There is a stamp that shows either 40k or Apocolype on it, the Avenger is usable in any Warhammer 40k book, so is legal.

 

Now ofcourse you will find there are some that don't like forgeworld miniatures for whatever reason, but if you can point that out to them that makes the difference.

Me i personnally like to use mine, and when i get people claim its not legal i whip out the book and show them.

Aye, but so does Cities of Death, City-Fight, Spearhead, Battle Missions, and Planet Strike. They're supplements that modify the base game, and just about any supplement beyond the core codices may be subject to consent.

 

Also, I thought they prohibited flyer deep strike in something around the skys of death  supplement?

Lets not forget the fact it has a heavy defence snubber that has skyfire and can fire at a different target from the others.  With it still having deepstrike, the number of shots, AND SKYFIRE it say it is worth its points.  its not that much more and it is far better at removing whole units from the table and GREAT at killing monsterous creatures
